BART shooting hearing begins today

JUSTICE FOR OSCAR GRANT

A preliminary hearing for the former BART police officer Johannes Mehserle-who shot an unarmed rider on New Year's Day-begins today.

The purpose of the hearing is for the prosecution to attempt to persuade a judge to bring the case before a jury. The hearing was originally planned for March 23, but was postponed at the request of the defense attorney in the aftermath of the slaying of four Oakland police officers.

The San Francisco Chronicle reported that the hearing could last two weeks, with witnesses from both prosecutors and defense attorneys.

Defense attorney Michael Rains, known for getting the infamously crooked cop gang the Oakland "Riders" off, is trying to get the charge of murder down to manslaughter. He also attempted last week to get the county District Attorney's off the case. If this happens, State Attorney General Jerry Brown's office will take over.

Mehserle has pled not guilty to the charge of murder and is out on $3 million bail.

Oscar Grant's family has filed a $50 million wrongful death civl suit against BART.

Protestors plan to rally outside today, as well as other days of the trial.

Journalist and Hip Hop historian Davey D reports: "Last week The BURNERZ (Zumbi of Zion I and the Are of The Burnerz) recorded the track "Cop Hate Kidz," a tribute song in response to the murder of Oscar Grant by a Bart Police Officer, as well as the murder of four Oakland [OPD] officers last week.

"The tragedies that we are witnessing can be attributed to the long history of police brutality experienced in the black and brown communities," notes MC Zumbi, who adds that this is a different song than people might be used to from the Zion I member, but that is point. "It's supposed to make cats feel uncomfortable and get people thinking."

Former BART police officer killed unarmed Oscar Grant, III on New Year's Day

Protestors enraged, nine arrested
Former BART police officer Johannes Mehserle, who killed the unarmed Oscar Grant III, meant to fire his taser and not his gun, according to his defense attorney who convinced a judge to set bail Jan. 30. He remained in jail through Friday night, according to the County Sheriff's Department, despite reports that he was released.

A few dozen people packed the Alameda County Courthouse lobby Friday afternoon for the bail hearing's 43 available seats while hundreds more protested outside the courthouse. Inside the courtroom, the front rows were reserved for the families of both Grant and Mehserle.
